USER NOTICE
Useful Networks alone operates the sniff™ Service (the "sniff Service"). Your mobile operator corporation and its affiliates and subsidiaries only provide the location data (defined and discussed below) and phone transmission for data sent by Useful Networks, you and others. Your mobile operator is not responsible for the sniff Service, its content or operation; Useful Networks is responsible for the sniff Service. You'll reveal your personal information and location through the sniff Service at your own risk. Your mobile operator disclaims any responsibility when others post information, or get your personal information and locate you through the sniff Service. Your mobile operator only provides the location data (defined and discussed below) and phone transmission for data sent by Useful Networks, you and others. Your mobile operator is not responsible for the sniff Service,its content or operation; Useful Networks is responsible for the sniff Service. You'll reveal your personal information and location through the sniff Service at your own risk. Your mobile operator disclaims any responsibility when others post information, or get your personal information and locate you through the sniff Service. By using the sniff Service: (a) you acknowledge that your mobile operator makes no warranties of any kind regarding the sniff Service and expressly disclaims any implied warranties, including warranties of merchantability and fitness for a particular purpose; (b) you waive any claim you might otherwise have, and you agree not to bring any claim or complaint anywhere, against your mobile operator arising out of the operation or failure of the sniff Service; (c) you agree that all other terms of your current subscriber agreement with your mobile operator apply to the sniff Service insofar as your mobile operator provides the location data to enable, and the phone connection to transmit, the sniff Service; (d) you agree that except as noted in (c) immediately above, operation and use of the sniff Service are governed by sniff privacy policy which alone will apply to the sniff Service and all data and acts related to the sniff Service; and (e) you agree to indemnify your mobile operator against any claims, losses, or damages arising out of your use of the sniff Service.
In addition, you agree: (a) to be located, and consent to have your mobile operator release your location data as it pertains to the sniff service and (b) the location service accuracy can vary depending on the users situation (i.e. in rural vs. urban areas) and (c) the service provider has the right to terminate the service.
LOCATION INFORMATION NOTICE
sniff Service is capable of allowing others to know where you are located using real-time location information. To provide this aspect of the sniff Service, Useful Networks collects, uses and discloses your personal data and the real-time geographic location of your cell phone or other mobile device - we call this "location data". Please note that this location tracking may occur even when the sniff Service is not actively running on your cell phone or other mobile device. By providing your consent, you authorize Useful Networks and your mobile operator to collect, access, use and disclose the geographic location information of your your carrier device and other personal and account information (i.e. name, address, telephone number, account number, equipment identifiers, Internet Protocol addresses, etc.) to certain third parties in order to enable the delivery and administration of your selected LBS application; including the functions that are incidental and necessary to such delivery (i.e. invoicing, etc.). You also expressly authorize Useful Networks to collect and use this location data and to disclose this location data to Useful Networks contractors, and certain third-party partners that provide features and functionality within or distribution of the sniff service and to any friends that you choose to accept and consent to view and use your location through. At any time, you may approve or deny a particular friend's access to your location by changing your sniff Service privacy settings. You have the right at any time to reject these uses of your location data and to deny or withdraw your consent; denial of consent will not affect your regular mobile phone service, but will prevent you from using sniff Service. To stop sharing your location entirely at any time or withdraw your consent to Useful Networks' use of location data - send "STOP" to 76433 or do so at www.sniffu.com. Furthermore, by providing your consent, you (1) acknowledge that your consent serves as consent on behalf of all persons who use your your carrier device ("End Users"); (2) acknowledge that you are responsible for notifying each End User that his/her geographic location information may be identified through your your carrier device using the sniff Service; and (3) agree that you will clearly, conspicuously, and regularly notify in writing all End Users that their location may be identified through your your carrier device using the sniff Service.
